Unfair business practice
|
I signed up for their one year contract, and in July 2011, two months before my contract was over, I went in to Massage Envy and gave them written notice that I wanted to cancel my membership when the contract is over, as it is stated in the contract, otherwise they would continue to bill me monthly.
A few days later, I got a voicemail from a manager, Christina, stating that she received my written notice, that I had two months left on the membership before it would be cancelled, and that if I had any questions to call her back. I attempted to call her back several times, but she was never available, and she never returned my calls. However, since she acknowledged receipt of my written notice to cancel, I was confident that the membership would be cancelled.
In December 2011, three months after the contract was over, I noticed that Massage Envy was still charging my credit card monthly. I went back in to Massage Envy and talked with another manager, Taylor. She told me that Massage Envy "requires" customers to talk to a manager before they cancel a membership. I told her that was not what was written in the contract, and that the contract says I only had to give them written notice, which is what I had done. She told me that she would refund the three extra months. I am still waiting for a refund.
I feel this is wrong as Massage Envy is violating the contracts they made with customers by not canceling the membership when the customer has done everything the contract says to do in order to cancel. I will never return to a business that deals this way with customers.
